Depending on the reason for cancellation, you may be able to reclaim these cancellation charges (less any applicable excess) under the terms of any insurance policy you may have. Claims must be made directly to the insurance company concerned.
Changes and cancellation by us
Occasionally, we have to make changes to and correct errors on our website descriptions and other details both before and after bookings have been confirmed and cancel confirmed bookings. Whilst we always endeavour to avoid changes and cancellations, we must reserve the right to do so.
If we have to make a significant change to or cancel your booking, we will tell you as soon as possible. We will endeavour to offer you an alternative should a significant change or cancellation occur.
We regret we cannot pay any expenses, costs or losses incurred by you as a result of any change or cancellation.
Very rarely, we may be forced by “force majeure” (see Clause 7 in terms and conditions) to change or terminate your stay after departure but before the scheduled end of your time away. This is extremely unlikely but if this situation does occur, we regret we will be unable to make any refunds, pay you any compensation or meet any costs or expenses you incur as a result.
The Security Deposit
The Tenant must pay a Security Deposit of £500 to the Landlord with the Rent, to be held by the Landlord until after the end of the Term as security towards the Tenant’s liability for telephone charges or items requested via the TV service which is provided (if applicable), damage, nuisance and any other sums that may be due from the Tenant to the Landlord under this Agreement.
The Security Deposit shall be refunded to the tenant 7-10 days after the end of the Term (without interest) under deduction of such sums that may be due to the Landlord from the Tenant as a result of any breach of the Tenant’s obligations.
The Security Deposit, or remainder thereof, will be refunded by the same means as it was received via bank transfer, credit card or PayPal account. In the case of expired accounts, YourBrightonHoliday will contact you by email or telephone to ask you to provide new bank/card details. For security reasons and protection against fraud, deposit payments can only be refunded to the original payee.
If there is a claim for damages or losses caused by you or your actions, or if any service charges incurred by you exceed that of the security deposit amount, you will be responsible for paying us any additional monies required immediately on request from us. If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with our own and the other party’s full legal costs) as a result of your actions. We may act on behalf of Your Brighton Holidays clients to claim on their behalf in a small claims court.
